1. Purpose and Scope
The Pepelwerk Coach Portal provides a structured environment for authorized coaches, advisors, and organization-designated personnel to schedule interactions, review permitted user information, and support users in navigating Pepelwerk platform features and pursuing their self-defined goals. The Coach Portal is an administrative, scheduling, and interaction tool only. It does not provide decision-making, advisory, or evaluative functionality. This Agreement governs access to and use of the Coach Portal by: Pepelwerk-contracted coaches Organization-based advisors (including employees, instructors, HR personnel, or other authorized representatives) Administrators managing coaching access
2. Nature of Pepelwerk Services
Pepelwerk provides informational, assistive, and decision-support interactions through artificial intelligence and human service providers, including prompts, questions, and data-driven outputs designed to support user-directed decision-making. Pepelwerk does not provide advice or make decisions on behalf of users. All Coach Portal interactions are subject to this definition.
3. Coach Role and Responsibilities
Coaches and advisors: Facilitate user-led discussions Help users navigate platform features Support goal-oriented reflection and planning Coaches and advisors do not provide professional advice, make decisions, or act on behalf of Pepelwerk or the user. All interactions are intended to support user reflection and independent decision-making. Coaches must document interactions using neutral, factual, and non-judgmental language and may not include evaluative, subjective, or diagnostic statements about users.
4. Independent Contractor and Organization Roles
Pepelwerk-Contracted Coaches Pepelwerk-contracted coaches are independent contractors and are not employees or agents authorized to provide advice, make decisions, or bind Pepelwerk. Their interactions reflect individual perspectives and are not official positions of Pepelwerk. Pepelwerk does not control, direct, or guarantee the content of coaching interactions. Organization-Based Coaches Organization-based coaches and advisors operate independently under their organization’s policies and are solely responsible for complying with employment, privacy, and applicable workplace laws. Pepelwerk does not direct or control how organizations use coaching interactions or user information.
5. Coaching Interactions and AI Outputs
Coaching interactions and AI-generated outputs are informational, assistive, and decision- support interactions and do not constitute advice, recommendations, or decisions. Pepelwerk does not undertake any duty to ensure that coaching interactions, AI outputs, or other system interactions are accurate, complete, fair, or appropriate for any specific outcome. Users remain solely responsible for evaluating and acting on any information provided.
6. Coaching Notes and Session Records
Nature of Coaching Notes Coaching notes are non-evaluative summaries of user conversations and are not performance assessments, endorsements, rankings, or evaluations. Coaching notes are not official records, employment records, educational records, or system-of-record documentation. Permitted Use Coaching notes may be used only for: Supporting user engagement Facilitating conversations Improving interaction with the platform Prohibited Uses Organizations may not use coaching notes, session summaries, or coaching interactions: As the sole or determinative basis for employment, advancement, compensation, or eligibility decisions To create rankings, evaluations, or performance indicators To influence legal or material decisions without independent evaluation Coaching notes are not decision-support tools and must not be used to derive conclusions about user suitability, capability, or performance. Data Ownership and Access Coaching notes do not transfer ownership of user data. Users retain control over their Talent Wallet, profile information, and personal data, subject to user consent and platform configuration. Access to coaching notes is limited to authorized users within the same organization context and restricted by platform permissions. Pepelwerk does not provide cross-organization visibility or shared access to coaching records. Additional Protections Coaching interactions and notes are not intended to create behavioral profiles, predictive assessments, or performance indicators. Pepelwerk may limit retention, accessibility, or persistence of coaching notes based on platform design and operational needs. Pepelwerk does not monitor, evaluate, or validate coaching notes or interactions for accuracy or quality.
7. Scheduling and Access
Scheduling and access to coaching sessions do not guarantee availability, outcomes, results, or quality of interaction.
8. User and Organization Responsibilities
Users are solely responsible for evaluating and deciding whether to act on any information discussed during coaching interactions. Organizations are responsible for ensuring that their use of coaching interactions and data complies with: Employment laws Privacy laws Civil rights laws Nondiscrimination requirements Organizations may not use coaching data in a manner that violates applicable legal or regulatory requirements.
9. Prohibited Use of Coach Portal
Users of the Coach Portal may not: Evaluate or rate users Create structured or informal performance assessments Use coaching notes to make employment or eligibility decisions Share notes outside authorized access scope Use platform data for undisclosed or unlawful purposes
10. Coach Performance Monitoring
Pepelwerk may collect and review operational data related to coaching activity, including: Session completion Scheduling activity Participation metrics User engagement feedback This data is used for administrative, platform management, and compensation purposes only. Pepelwerk does not undertake any obligation to evaluate, guarantee, or ensure the quality or outcomes of coaching interactions. User feedback reflects personal opinion only and does not constitute evaluation or endorsement. Pepelwerk may, but is not required to, review or act on performance data. Coach performance data is for internal use only and is not shared with organizations or used to influence platform outputs or user interactions. Tracking of session activity supports compensation processes and does not verify the quality or substance of interactions.
11. Compensation and Relationship Disclaimer
Compensation of coaches by Pepelwerk does not create an advisory, fiduciary, or professional services relationship between Pepelwerk and users.
12. No Professional Services
Pepelwerk and its service providers do not provide licensed, regulated, or professional advisory services. Coaching interactions do not constitute legal, employment, financial, educational, or professional advice.
13. Relationship to Other Agreements
This Agreement supplements and is incorporated into: Pepelwerk Terms of Use Org Portal User and Account Agreement AI Recommendation Terms and Limitations Guidance Agreement Privacy Policy The Terms of Use govern in the event of any conflict.
